Belediye sınırı sorununun kentsel etkileri : Batman Belediyesi örneği

Abstract

Bu araştırma kapsamında Batman Belediye sınırı sorunu çalışma konusu olarak ele alınmış olup, kent ölçeğindeki etkileri ortaya konmuştur. 1955 yılında kurulan Batman Belediyesi'nin 2009 yılına kadar onaylı bir sınırı bulunmamaktadır. Yerel yönetim planı sınırı doğrultusunda kentsel hizmetleri sağlamaya çalışmıştır. 2009 yılında belediye sınırı kesinleşmiştir ancak; sınır onaylanırken kentin çevresinde bulunan köylerin tüzel kişiliği kaldırılmamış ya da köy sınırları daraltılmamıştır. Belediye sınırının onaylanması ile köy tüzel kişilik sınırı ile belediye tüzel kişilik sınırı iç içe geçmiştir. Belediye sınırı ve köy sınırlarının iç içe geçmesi ile il özel idaresi ve belediye arasında yetki karmaşasının yaşanmasına sebebiyet vermiştir. Yetki karmaşası nedeniyle yerel yönetim tarafından sınır sorunu yaşanan alanlara kentsel hizmetler götürülememektedir. Bu durum yerel yönetimin etkin ve verimli çalışmasını engellemektedir. Kanunlarla bu sorununun nasıl çözüleceğine dair hükümler belli iken bu sorun bir türlü aşılamamaktadır. Bu sınır sorunundan en çok kentte yaşayanlar etkilenmektedir.

Whether the border problem of the municipality of Batman is dealed within this scope as studing issue it‟s effects in urban scale is presented. There was no approved border of Municipality of Batman which is established in 1955 until 2009. It have tried to provide urban service toward the border of local management plan. In 2009 the border of municipality finalized but; when the border was approved neither legal entity of villages around the city could be rescinded nor the villages could be conricted. By approving the border of municipality, the border of village and the border of city legal entity are interlocked. Interlocking between the border of municipality and the borders of city villages caused an authoring chaos between Provincal Special Administration and Municipality. Because of authority chaos, urban service can not be given by the local goverment to the areas which have problem of border. This prevents local goverment to works actively and efficiently. Although it is clear that how this problem can be solved legaly, it can not be solved in no way. The people who live in the city are mosty affected by this problem of border.
